OnePlus 10 Pro5G Launch Gift Redeem Campaign Terms & Conditions


When Participants enter the OnePlus 10 Pro Launch Gift Redeem Campaign ("Campaign"), Participants agree to abide by, and be bound by, these OnePlus 10 Pro Product Launch Gift Claim Campaign Terms & Conditions ("Rules"), as defined below:

1. Promoter
The promoter of the Campaign is Reflection Investment B.V. ("Company").

2. The Campaign
2.1 The Campaign is OnePlus 10 Pro5G Launch Gift Redeem Campaign (the “Campaign”).

2.2 Campaign Period: The Campaign will include 2 sessions, targeting at different users who purchase OnePlus 10 Pro from different retail partners.
A. Participants who purchased OnePlus 10 Pro on oneplus.com or OnePlus Store app during 31st March to 12th April (the “Campaign Period”), will be added a OnePlus Buds Pro as a gift by default, while the gift stock lasts.
B. Participants who purchased OnePlus 10 Pro on authorized OnePlus retail partner, can get a free OnePlus Buds Pro redeem code on the registered OnePlus account as long as the device is linked on OnePlus Store app or at settings of the device, during 31st March to 26th April (the “Campaign Period”). Additional terms and conditions issued by authorized OnePlus retail partner may apply for such purchase.

2.3 Eligibility
1) The Campaign is open to individuals (each a "Participant"; collectively, the "Participants");
A. Over the age of eighteen (18) residing in eligible regions and delivery address in Europe, where there is OnePlus authorized retail partners, excluding Norway, Iceland, Ukraine, Switzerland, Malta and Cyprus ("Territory");
B. holding valid OnePlus account and owned OnePlus 10 Pro;
C. Installed and activated OnePlus Store app on OnePlus 10 Pro, and complete "Link My Device" on Service section; or enter the settings section, log in OnePlus account and click "Link Device";
2) This Campaign is applicable for OnePlus 10 Pro purchased on oneplus.com or OnePlus Store app, or other OnePlus authorized retail partners;
3) Due to legal restrictions, the Company is unable to accept participations from the countries/regions which may be subject to export controls or sanctions at the time of the Campaign if their purchase leads to the violation of to the relevant law or regulation.
4) The Campaign is subject to the EU version officially designed and sold by OnePlus in Europe, or UK version sold in the United Kingdom or Republic of Ireland. Any device that is not an EU or UK version or purchased from a non-official authorized sales channel shall be excluded from the Campaign;
5) Should shipping to a Participant's address be excessively difficult, expensive, or outside of OnePlus's region of service, the Company may, at its reasonable discretion, decline an order.
6) By participating in the Campaign, the Participant represents and warrants that he/she has met all the Eligibility criteria.

1. How to Redeem the Gift for OnePlus 10 Pro5G?
1) Company will communicate the details of the Campaign through designated official Company channels ("Company Channel"), including the Campaign website (https://www.oneplus.com) ("Website"), official OnePlus Store app, official Company social media channels, and through official communications from Company retail partners.
2) Participants shall choose to join the Campaign via one of the options listed below. The free Buds Pro for OnePlus 10 Pro shall be redeemed only once during the campaign period;

Option 1: OnePlus 10 Pro purchased on oneplus.com or OnePlus Store app.
A. Participants who purchased OnePlus 10 Pro on oneplus.com or OnePlus Store app during 31st March to 12th April, will be added a OnePlus Buds Pro as a gift by default when checking out.
B. Participants will not be eligible for receiving free Buds Pro redeem code via "Link My Device" on OnePlus Store app, or "Link Device" on settings of the device.
C. If the purchase is withdrawn, the gift of Buds Pro shall be returned together with the phone.

Option 2: OnePlus 10 Pro purchased on authorized retail partner
Participants who purchased OnePlus 10 Pro on authorized OnePlus retail partner, shall get a free OnePlus Buds Pro redeem code on the registered OnePlus account as long as participants complete "Link My Device" on OnePlus Store app or settings of the phone, during 31st March to 26th April.

How to "Link My Device" to get free Buds Pro?
A. Start at the OnePlus Store app >> Service >> Link My Device, or start at the settings of the device.
B. Click “Link Device”, the device will automatically validate its IMEI information to check if the device is an eligible OnePlus 10 Pro. Please be noted that OnePlus 10 Pro purchased on oneplus.com or OnePlus Store app is excluded to get the free Buds Pro code.
C. Once the participants successfully complete "Link Device", a free Buds Pro redeem code will be issued to the logged in OnePlus account directly.
D. The free Buds Pro redeem code shall be valid within 30 days after receiving the code, and the code can only be redeemed via the regular purchase of OnePlus Buds Pro Matte Black or Glossy White on oneplus.com or OnePlus Store app. The code shall be redeemed within the validity time when the stock for Buds Pro is enough for regular purchase.
E. The detail validity time of redeem code shall refer to the "Validity Date" displayed under Coupons/Gift Codes/Cash Coupons section of the account.

How to have a OnePlus account?
User can choose to register a OnePlus account through either:
a. sign up ononeplus.com;
b. sign up on OnePlus Store app >> Account section;
c. sign up on the device >> settings.

4. Please be Aware of the following.
1) For OnePlus 10 Pro purchased on oneplus.com or OnePlus Store app will get the free Buds Pro directly when checking out and will be delivered together with the phone during Campaign Period. If participants choose to cancel the tick of “Free Gift” when checking out, it will be considered as the participants abandon the free Buds Pro gift. The gift will not be added or compensated afterwards.
2) The free Buds Pro gift or redeem code is available on oneplus.com or OnePlus Store app where online purchase is available in the corresponding country, during the Campaign period, or while stocks run out, which one is earlier.

5. General Liability Release.
By participating in this Campaign, Participants release Company, its employees, agents, affiliates, and assigns from any liability whatsoever, on any theory, and waive any and all claims and causes of action arising from or related to this Campaign and/or fulfilment and/or use of the discounts, to the extent permitted by applicable law. However, nothing in these Rules limits or excludes any person's or entity's liability for death or personal injury caused by their negligence or any other liability which may not be limited as a matter of law.

6. Data.
1) By entering the Campaign and submitting any other personal information, Participants are expressly consenting to the processing of their personal information by Company for the purpose of the Campaign or any associated publicity by Company or its affiliates. Company's Privacy Policy will apply (https://www.oneplus.com/legal/privacy-policy). Company may share the personal information with partners and authorized licensees for Campaign administration and discount fulfilment purposes.
2) The Participant consents to his/her Personal Data being transferred, stored (both electronically and manually) by Company to Company and its business partner(s) located outside of the European Economic Area for the purposes of maintaining records of the Campaign and developing Campaign-related external marketing materials ("Materials"). The Participant hereby agrees that such usages shall constitute legitimate business needs for Company.
3) The Participant further acknowledges and agrees that his/her participation in the Campaign may result in his or her name, social media handle and other personal data ("Personal Data", as defined below) being announced publicly. The Participant hereby waives any and all objections to such disclosures in the Materials.
4) For the purposes of this Agreement, "Personal Data" may include, but is not limited to name, birthdate, passport or ID number, home address, contact information, likeness or appearance. Company and its partners shall only retain the Participant's Personal Data only as long as it may be needed.
5) The Participant acknowledges that collection and processing of the Personal Data listed in Section 6.4) for the uses described herein shall constitute a legitimate business need of the Company.
6) Company undertakes to ensure that it and its partners will take appropriate measures to protect Participants' Personal Data and use Participants' Personal Data only for the purposes described in this Agreement. Both Data Controller(s) and Data Processor(s) shall sign data processing agreements (DPAs) to meet the European Union's requirements with respect to data processing.

7. Interpretation and Disputes

Participants agree:
A. To be bound by these Rules and all decisions of the judges, which are final and binding.
B. That any disputes shall be governed by the laws of England & Wales (or by mandatory local laws, if applicable). Nothing in Rules affects the rights of the consumer to rely on the mandatory local law.
C. That any disputes, subject to the mandatory local laws, shall be resolved through binding arbitration conducted via the London Court of International Arbitration (LCIA) in accordance with the said Rules in force at the time. The seat of arbitration shall be London and language of arbitration shall be English.
D. Should there exist any conflict between these Rules and any other communication, including but not limited to Company Channel communication, email, public statements by Company employees/agents, or any other form of communication, these Rules shall prevail.

8. Miscellaneous.

1) Void Where Prohibited
The Campaign is void where prohibited: If any provision or part-provision of these Rules is held by a court of competent jurisdiction to be invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these Rules. To the extent permitted by applicable law, Company may suspend, modify or terminate the Campaign if it believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper conduct of the Campaign, in which case the gift will be awarded among the eligible participation that were unaffected by the problem, if possible.
2) Non-discrimination
The Company conducts the Campaign in accordance with all relevant equality and anti-discrimination law (whether in relation to race, sex, gender reassignment, age, disability, sexual orientation, religion or belief, pregnancy, maternity or otherwise).
3) Company is entitled to exclude Participants from this Campaign who violate this Rules, provide false, misleading or fraudulent information, or use unfair means. In addition, participation in the Campaign via dubious, fake accounts is not permitted. If there is a reason for exclusion, Company is entitled to withdraw the gift, to reclaim the gift that have already been handed out, or to demand compensation for the value.
4) Company will not be responsible or liable for: (a) any late, lost, misrouted, or damaged participation and other conditions beyond its reasonable control; (b) any other losses or damages caused by events beyond the reasonable control of the Company.
