    Privacy Policy

    1. Introduction

    1.1 This Privacy Policy explains how OnePlus Technology (Shenzhen) Co., Ltd., along with its affiliates (referred to as we, us or OnePlus), collects, uses, discloses, transfers, stores and protects your personal information and what corresponding rights you have in relation to the processing of personal information. Personal information refers to any information related to an identified or identifiable natural person or household.

    1.2 This Privacy Policy concerns the following information that we collect about you:

    (A) Information we receive through our website at https://www.oneplus.com/us;

    (B) Information we receive through our products (such as mobile devices);

    (C) Information we receive through our support services, mobile applications or platforms.

    1.3 If this Privacy Policy does not cover certain scenarios where we use your personal information, we will explain these to you separately.

    2. How we collect your personal information

    2.1 For many of the products or services that we provide, we are likely to ask you to provide personal information. If you do not provide the relevant information, we may not be able to provide you with our products or services or respond to any queries you may have. For example, you may not be able to purchase a OnePlus product, our call center may not be able to reach out to you and provide you with pre-sales or after-sales services, and you may not be able to download or update software and/or mobile applications.

    2.2 The information you provide helps us design, update and improve our products and services, and provide marketing and promotional information to you. We may combine your personal information with other information we collect to better understand your needs.

    2.3 In relation to our website, products and service, we will collect and process the following personal information about you: (1) information you provide to us directly; (2) information that we collect or generate when you use our products or services; and (3) information about you which we obtain from third parties.

    (A) Personal information directly provided by you. This includes (by way of a non-exhaustive list) the following information.

    (1) When you register an account with our website or products, or purchase a OnePlus product, we may require you to provide relevant personal information, such as your username and password, first and family name, gender, phone number, email address, mailing address, zip/postal code, region, country delivery details, method of payment, bank account details, billing address, and other financial information.

    (2) When you call our customer service centre for assistance, we may require you to provide your name, phone number, product information, delivery time, contact and communication records.

    (3) If you participate in one of OnePlus’ offline product experience events, we may collect your personal information such as your name, gender, email address, and phone number.

    (4) When you register an account or use the services on OnePlus’ Community platform, you may be required to provide your personal information such as your username and password, profile picture, country or region, email address, phone number, gender, date of birth, social media accounts, delivery details, or mobile device details. If you attend the events held on OnePlus Community such as Shot On OnePlus event, you may provide your photos or other personal information to us.

    (5) We may ask you to provide personal information under other circumstances, such as when you participate in promotional or marketing activities organised by us, participate in an online survey.

    (6) When you choose to share information on our website which may be considered personal information.

    (7) Personal information you post on OnePlus’ Community platform, such as photos.

    (B) Information that we collect or generate when you use OnePlus products or services. This includes (by way of a non-exhaustive list) the following information:

    (1) Device information: such as the device name and model, device ID (such as IMEI and serial number), operating system version, language settings, time zone, information of telecom operator (such as operator name, MCC/MNC), log information (such as system error log).

    (2) The type and version of browser used when you login to our website, resolution, website operating elements, IP address, web browsing information, users’ behavior and preference, statistical data (such as how many times you use the app or login to our website) what sites you visited, any documents downloaded, security incidents, prevention measures taken by the gateway, and other basic system/device information.

    (3) Any information regarding the products or services purchased and/or used on our website and our interactions with you.

    (4) A file with your contact history to be used for enquiry purposes so that we may ensure that you are satisfied with the products or services which we have provided to you.

    (5) Location information such as the country information displayed by the telecom carrier code you use, the GPS signal of your mobile device, information about WIFI access points. We may collect your GPS location information if you use location-based apps such as maps, navigation and weather service apps. You can turn off the location sharing service of your devices to stop sharing your device's location information.

    (6) Call information: when you use the instant voice translation function on your device and/or if the other person to whom you are talking has turned on the translation function, your personal information may be captured by us as part of translating the call information. Such information will be sent to a third party for translation and not be stored by us. In such a case, the service provider may receive and store your voice information; we in no manner control the privacy or security practices followed by such third parties and you are thus recommended to check privacy policies of such third parties to understand how they use your information. We will seek your separate consent to the use of your personal data for the purpose of the instant voice translation function when you try to turn on the function on your OnePlus device. You may withdraw your consent at any time. If the other person to whom you are talking has enabled this translation, but you do not agree to your information being processed as part of the instant translation function, you can ask the other person to switch off the function or hang up the video call at any time. If you don’t consent or withdraw your consent to the use of your personal data, you will not be able to use the instant translation function.

    (C)Information about you which we obtain from third parties . This includes (by way of a non-exhaustive list) the following information.

    (1) Social media networks. For example, when you use a third party account (such as Facebook or Google) to register for an account with OnePlus or log in to our website, we will obtain your account information (such as account ID, email address and profile picture) from these third parties.

    (2) Other providers of products, services, website and apps.

    (3) Other commercially or publicly available sources.

    3. How we use your personal information

    3.1 We may process your personal information in the following ways and for the following purposes.

    (A) To keep our products and services secure and prevent crime and fraud. For example, we may use your personal information for authentication, security, fraud monitoring, in-depth threat analysis, archiving and backup purposes and for statistical monitoring and analysis of current attacks on devices and systems and for the on-going adaptation of the solutions provided in order to ensure the security of our products and services.

    (B) To provide and maintain our products and services. We may use your personal information to allow you to use and access the functionality of our products and services. This includes using your information to process your orders, receive or deliver products, refund payments and provide after-sales maintenance.

    (C) To contact you in relation to our products and services. We may use your personal information to understand your feedback and to communicate with you in order to provide you with services or information about our products. For example, if you post content on our website indicating that you have a complaint about a product or service, or need technical assistance, we will contact you to obtain further information and provide you with assistance.

    (D) To improve our products and services or develop new ones. We may use your personal information to develop new features and functionality, to improve our operational system, software and interface design, we may use the error reports to improve security features, or we may adjust after-sales service network layout according to your location, language settings and other users’ preference.     (E) To promote and personalise our products and services. We may use your personal information to better understand your needs and interests in order to personalise our products and provide you with more tailored services (such as our latest products, services and activities), or send you holiday greetings. We may require your consent for some of this marketing activity. In such cases where consent is required, we will only conduct the marketing activity if we have obtained your consent.     (F) To administer our business and to comply with legal obligations. We may use your personal information for the management and administration of our business (including administering and maintaining databases storing personal information) and in order to comply with and assess OnePlus’ compliance with applicable laws, rules and regulations, and internal policies and procedures.

    If we want to use your personal information for other purposes not covered by this Privacy Policy or if we want to use your personal information which was collected for a specific purpose other than the above, we tell you about that and ensure that the use of your personal information complies with the law and is consistent with this Privacy Policy.

    3.2 We are allowed to use your personal information in these ways because of one or more of the following apply:

    (B) we need to do so in order to perform our contractual obligations with you;

    (C) we have legal and regulatory obligations that we have to discharge; or

    4. Face and fingerprint recognition

    4.1 In order to use the face and/or fingerprint recognition function to unlock your mobile device, your device will capture images of your face from different angles and/or scan your fingerprint. This information will only be stored locally within your mobile device and not uploaded onto our servers.

    5. How we use cookies and similar technologies

    6. How we share your personal information

    6.1 We may disclose your personal information within the OnePlus group of companies who will have appropriate confidentiality and security measures, at least as protective as those described in this Privacy Policy, to handle personal information. We only share necessary personal information subject to the purposes stated in this Privacy Policy.

    6.2 We may also disclose your personal information outside of the OnePlus group for the following purposes:

    (A) to third party agents, service providers and contractors for the purposes of providing services to us. For example, the third party that provides the translation function or when you purchase our products through our online store, we will disclose your order information and delivery information to our authorised logistics service providers, and your payment information will be processed by payment service providers. In addition, we may disclose your information to OnePlus’ accountants, professional advisors, IT and communications providers and debt collectors. We will disclose your personal information to such third parties only to the extent permitted by law and we require our service providers to process and protect your personal information in compliance with relevant cybersecurity laws, regulations and relevant industrial standards (such as PCI DSS and ISO 27001 certification);

    9.1 The length of time we will hold your personal information will vary and will be determined by the following criteria.

    (A) The purpose for which OnePlus is using it: we are required to retain the personal information for as long as is necessary to satisfy or meet the purpose for which it was obtained or any other legal purpose.

    10.3 The personal information record created through your registration with our services can only be accessed with the unique password associated with that record. To protect the integrity of the information contained in this record, you should not disclose or otherwise reveal your password to third parties.     11.1 OnePlus has a global business and our operations are spread around the world. As a result, we collect and transfer personal information on a global basis.     15. How we respond to Do Not Track Signals

    15.1 The “Do Not Track” (DNT) privacy preference is an option that may be made in your web browser allowing you to opt out of tracking by websites and online services. Because there is not yet an accepted standard for how to respond to a DNT signal, we do not support DNT browser settings and do not currently participate in any DNT frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of your personal information.

    Terms of Sales

    Payments

    Prices and currencies displayed at checkout are final. OnePlus does not charge extra transaction fees. If you are paying for your order with an international credit or debit card, the price displayed in your card statement may vary in accordance with exchange rates. Your bank or card issuer may also charge additional foreign conversion charges and fees, which may increase the overall cost of your purchase. Please contact your bank or card issuer regarding any fees incurred. Note: seller is located in Hong Kong.

    Payments on oneplus.net are handled by PayPal or CyberSource and transmitted using the Secure Sockets Layer protocol (SSL) with 2048-bit encryption. OnePlus does not store or have access to your payment details. Your credit/debit card information is retained via PayPal’s or CyberSource’s servers.

    Cancellations

    OnePlus makes every effort to supply the Products listed in your Order Confirmation. In some situations, however, we will need to cancel your order. For example, (1) the item is no longer in stock; (2) the item is no longer being produced; (3) there is a price fluctuation; or (4) a Third Party notifies OnePlus that cancellation is necessary. If this is the case, OnePlus will cancel your order, notify you of the cancellation, and timely refund the money you have paid toward the Order. Unless the case involves violations of applicable national law, refund of the money you have paid toward an order will be the extent of OnePlus' liability to you for a cancelled order.

    Warranty Policy

    OnePlus phones purchased on oneplus.net come with a limited warranty of one (1) year starting from the date of delivery. Unless otherwise specified, this warranty covers the hardware components of the Product as originally supplied and does not cover, or partially covers, software, consumable items, or accessories, even if packaged or sold together with the Product. This warranty is only redeemable within the original country or region of purchase.

    The limited warranty only covers product defects caused by workmanship or build materials. To make a claim, please present your original Proof of Purchase (invoice), model and serial number of the Product, and photo evidence of the Product’s defects to OnePlus Customer Support at https://www.oneplus.com/us/support.

    OnePlus may use rebuilt, reconditioned or new parts and components when repairing any product. Alternatively, we may replace the defective product entirely with a rebuilt, reconditioned or new OnePlus product.

    Please note that we offer after sales assistance only in the areas where we make shipments (this includes repairs and/or replacements/returns)

    The limited warranty does not cover:

    • Defects or damage resulting from accidents, neglect, misuse or abnormal use; abnormal conditions or improper storage; exposure to liquid, moisture, dampness, sand, or dirt; unusual physical, electrical or electromechanical stress.
    • Scratches, dents and cosmetic damage, unless caused by OnePlus.
    • Defects or damage resulting from excessive force or use of metallic objects on the touch screen.
    • Devices that have the serial number or the IMEI number removed, defaced, damaged, altered or made illegible.
    • Ordinary wear and tear.
    • Defects or damage resulting from the use of the Product in conjunction or connection with accessories, products, or ancillary/peripheral equipment not furnished or approved by OnePlus.
    • Any physical feature defects or damage resulting from improper testing, operation, maintenance, installation, service, or adjustment not furnished or approved by OnePlus.
    • Defects or damage resulting from external causes such as collision with an object, fire, flooding, dirt, windstorm, lightning, earthquake, exposure to weather conditions, theft, blown fuse, or improper use of any electrical source.
    • Defects or damage resulting from cellular signal reception or transmission, or viruses and other software problems introduced into the Product.
    • Products not purchased from oneplus.net.
    • Repair conducted by un-official repair centers.

    Return and Replacement Policy

    OnePlus phones and accessories are made to the highest standards and undergo rigorous testing. If you are not satisfied with your OnePlus product for any reason, you may request a return within 15 calendar days of delivery. Once we approve your request and receive the returned Product, we will give you a full refund.

    Hardware purchased directly from OnePlus is covered by a Limited Warranty on workmanship and materials, commencing from the date of delivery and for the duration of:

    Return requests made outside of the 15-day period will not be accepted. We may also choose not to accept returns in the event of:

    • Defects or damages caused by misuse, neglect, physical damage, tampering, incorrect adjustment, normal wear and tear or incorrect installation after purchase.
    • Price fluctuations being the sole reason for return.
    • Customized customer contracts.

    In all cases, we will inspect the Product and verify the fault. To qualify for a replacement or refund, devices must be in "as new" condition and, with the original packaging. Accessories must be sealed in their original packaging. We reserve the right to refuse a refund if the Product returned is deemed to have been damaged.

    Please contact OnePlus Customer Support to request a return at https://www.oneplus.com/us/support. Without a verified return request, the returned package will be declined. Return requests cannot be cancelled once they have reached "Complete" status.

    Once you've contacted OnePlus Customer Support and requested a return:

    • You will receive and be required to submit a Return Merchandise Authorization (RMA) form. Print out the RMA form and place it inside of the shipping package you are returning.
    • Include all items from your original shipment, including devices, accessories, and documentation. Do not send additional accessories such as your SIM card, cases, screen protectors, or headphones. If such items are shipped to us by mistake, we are not able to return them.
    • Before returning any unit for service, be sure to back up your data. You are responsible for the personal information stored in your phone - please erase all personal and sensitive data from the device before sending it to OnePlus. OnePlus will not be responsible for any disclosure of data still on the returned or serviced device.
    • During service, data stored on the device may be deleted and reformatted. OnePlus is not responsible for the loss of any software programs, data or other information contained in the Product’s storage. Recovery and reinstallation of third party software programs, data and information are not covered under warranty.

    Partial Refund Policy

    All returned product(s) will be fully inspected. To qualify for a refund, the product(s) must be in new condition and, if possible, with the original packaging. We reserve the right to provide a partial refund or refuse a refund if the returned goods are deemed to have been damaged. You can refer to the details of the OnePlus Return Policy here. Please note, the return shipping fee for the rejected items will not be covered by OnePlus.

    Shipping Policy

    Orders are shipped within 2 business days of payment. Orders made during promotional periods and special events may have longer shipping times. Priority will be at the discretion of OnePlus. In such cases, customers will be informed in advance individually.

    To avoid damage, all goods are inspected and sealed before delivery.

    OnePlus will keep you updated on your order status via email. Orders cannot be cancelled once they have reached "Processing" status.

    How is shipping calculated?

    Shipping is calculated based on shipping address and shipping method. The following options can be selected during checkout:

    Standard Shipping (2 business days processing time + 3-7 business days)

    Priority Shipping (2 business days processing time + 1-3 business days)

    Please note that all delivery dates are estimates only. Additional charges will be necessary for shipping to addresses in remote locations. We are unable to ship to PO Box addresses.

    Events Beyond Reasonable Control

    Neither party will be responsible for any delay or failure to comply with these terms if the delay or failure arises from any cause beyond their reasonable control (wars, natural disasters, extreme weather conditions, etc.).

    We retain the right to take action at any time in the event of failure to comply with these terms.
