OnePlus USA Corp., a Nevada corporation with offices at 5000 Riverside Drive, Suite 300, Irving, Texas 75039 (“OnePlus,” “we,” or “us”), is committed to the protection and respect of your privacy. We may collect, use, disclose, transfer, process, share, or store your data and personal information (collectively referred to herein as “Your Information”) when you access, browse, avail, order, subscribe or use any of our products or services on or through our website and app (hereinafter referred to as the “Platform”). By doing so, you explicitly agree to be bound by this Privacy Policy. Please read carefully and familiarize yourself with our privacy practices before using our Platform, applying for any of our products or services, or providing Your Information on or through the Platform or engaging in any of the permitted activities on the Platform.

By using the Platform, you may access, browse, or apply for services or products (the “Services”) available on the Platform, and which may be updated on the Platform from time to time. In this Privacy Policy, we outline the purposes, methods and scope of our collection and use of Your Information, your rights pertaining to Your Information, and the security measures we take to protect Your Information.

The information we collect depends on the Services you use, the context in which you interact with us, the choices you make, and the products and services you view and use. We may collect Your Information, which includes:

  • Account information (including phone number, email address, password, profile picture,  and username).
  • User awards, coupons, and other items that are associated with your account.
  • Contact information (including your name, residential/shipping address, phone number or other contact details).
  • Order information (including proof of purchase, order number, shipping address, order amount, phone number, tracking number, and purchase history).
  • Payment information (including your name, bank details, credit, debit, or other payment card information).
  • User device information (including IMEI number, Android ID, model number,serial number, IP address, MAC address etc.) and how it interacts with the Platform
  • User group identity information (e.g., college students). In limited circumstances, we may ask you to verify your group identity information. This process is intended to verify if you are qualified to special offers.
  • Chat history, complaints, and other communications between you and OnePlus.
  • Information or content that you post, publish, display, or share on the Platform.
  •  Advertising IDs (including Google Ad ID).

You are not required to provide Your Information that we have requested. However, if you decide not to share Your Information with us, in many instances, we may be unable to provide you with relevant products and/ or respond to your inquiries or address any issues which you encounter.

Under California law, we are required to provide the following information regarding information that we collect from California residents. We may have collected the following personal information in the past 12 months:

  • Identifiers, which may include name, postal address, online identifier, Internet Protocol address, email address or account name.
  • Personal information described in Cal. Civ. Code§1798.80(e), which may include name, address, telephone number, bank account number, credit card number, debit card number, or any other financial information.
  • Commercial information, which may include records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Internet or other similar network activity, which may include browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.
  • Geolocation data, which may include physical location or movements.
  • Inferences drawn from other personal information, which may include a profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

In limited circumstances, we may have collected the following categories of sensitive personal information under California law in the last 12 months:

  • Account log-in and password.
  • Payment card number in combination with any required security or access code or credentials allowing access to an account.
  • Precise geolocation.

 

C. How We Use Your Information

We will use Your Information for the following purposes:

  • To create, maintain, manage, and notify you about your OnePlus account, programs, or subscriptions that you participate in.
  • To fulfill your orders, respond to requests for information or Services, provide customer support, and otherwise communicate with you.
  • To track and confirm online orders and to process refunds, returns, and exchanges.
  • To facilitate and manage your involvement in promotional activities such as prize draws, contests, and reward programs.
  • To market and advertise our Services, support our marketing activities and initiatives, and provide recommendations to our customers.

  • To deliver and improve our Services, including user registration for a Service, user identification, and authentication to enable activation, interaction with our Services and personalization of the user experience

  • To comply with and enforce applicable legal requirements, contractual obligations, relevant industry standards, and OnePlus’s policies.

D. How We Retain Your Information

We retain your information for the minimum duration necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required by law. Upon expiration of the retention period, we will either delete or anonymize your information.

We may share, transfer, or disclose Your Information to the following:

This information may be stored, processed and/ or used for the purpose of ongoing services provision, account creation, login requirements, notifications of new offers or updates, including software updates and patches, payment processing, OTP services, courier services for delivery of your purchase.

Notwithstanding the above, we shall not be responsible for the actions or omissions of any third parties with whom Your Information is shared by you nor shall we be responsible and/ or liable for any additional information you may choose to provide directly or indirectly to any of the third parties while applying for or activating their services and products whether directly or indirectly or whether through the Platform or otherwise.

We have implemented reasonable technical security and organizational measures to protect Your Information that is collected and stored by us. Although we take reasonable steps to protect Your Information, no website, Internet network or transmission, computer system or wireless connection is completely secure.

We will strictly control access to Your Information, granting access only to our employees who need to know to process such information, and authorized personnel from companies responsible for handling services on our behalf.

The security of Your Information is of great importance to us. Therefore, we will  safeguard Your Information by implementing protective measures, such as encrypting information storage and transmission, to prevent Your Information from unauthorized access, usage, or disclosure.

In the event of a security incident involving Your Information, we will, to the extent required by relevant laws and regulations, promptly inform you of the incident and the preventive measures to be undertaken to mitigate any potential damage.

To exercise the Right to Opt-Out of personal information sharing or selling, including for targeted advertising purposes, you may submit a request by clicking on the following link Do Not Sell or Share My Personal Information.   • Right to deactivate your OnePlus account. You can deactivate your account via https://www.oneplus.com/global/customer/info#/, by choosing “Deactivate my account”. Your account will have a 15-day deactivation period, followed immediately by account deletion. You may choose to reactivate your account at any time within 15 days. Afterwards, your account will be permanently deleted.

 

H. How We Process Personal Information of Children

Our Platform and Services are not intended for persons under the age of 18. We do not knowingly solicit or collect information from anyone under the age of 13. If it comes to our attention that we have collected personal information from anyone under the age of 13, we will promptly delete that information. If you believe anyone under the age of 13 has provided us with personal information without parental consent, please contact us as specified below in the “Contact Information” section of this Privacy Policy.


I. Third Parties and Their Products and Services

The Platform may contain links, products and/ or services from third party websites. You have the option to decide whether to visit them. However, if you choose to do so, your use of these websites will be subject to their terms and conditions and privacy policies which you can view at their websites or by contacting them.

We do not control the privacy and data protection policies of our partners. Therefore, before you submit Your Information to our partners, please read and understand their privacy policies and terms and conditions, as you will be governed by them, and your remedies shall lie against such partners and/ or third parties whose websites you visit and/ or whose services and products you apply and/ or activate.

Depending on the location of your account registration and network request, we will store your information in the appropriate country and region. For instance, if your account is registered in the United States and the network request is also made within the United States, your information will be stored on AWS US.

K. Communications from the Platform

Special Offers and Updates: We may send you information about products, services, special deals, as well as newsletters and other types of promotional offers and messages. In consideration of your privacy, we offer you with the option to opt out of receiving these communications. You can easily unsubscribe using the mechanism provided in each message.

Service Announcements: On certain occasions or in accordance with any laws or regulations, we may be required to send out service-related announcements and communications. These communications are not be considered promotional in nature.

Customer Service: We may engage in regular communicate with you to provide the services you request, as well as discuss matters related to your user account. Our response may be conveyed through email or phone, prioritizing your needs and convenience.
